The new Penal Process Code that started in 09/15 is strongly contested by judges,police and civil society.

The Courts gonna have to send home criminals because the preventive arrest is shortened.

1-The Portuguese judicial council refused overnight to allow the judge handling the case of missing British girl Madeleine McCann to speak publicly about the investigation to satisfy intense media interest.
Judge Pedro Frias, faced with unprecedented media pressure, had asked the national council of judges to allow him to explain to the public the progress of the criminal investigation into the girl's disappearance.

"The 'Madeleine case' has not yet gone past the investigation stage," it said in its ruling, adding that the request had been refused to protect the rights of the suspects.
Police have named Madeleine's parents, 39-year-old doctors Gerry and Kate McCann, as the main suspects in the disappearance of their daughter from her bedroom while the family was holidaying in southern Portugal in May. She was three at the time.
Portuguese and foreign media have reported contradictory rumours about the inquiry and the case against the couple.
Police meanwhile have provided no information about their suspicions, in line with Portuguese legal procedure.
They have presented their formal case against the couple to prosecutors, who submitted it to the investigating magistrate.
The magistrate has 10 days to decide what further lines of inquiry to pursue.
The McCanns have been under virtual siege from the media since their return to the village of Rothley, central England, shortly after they were named as suspects.
The McCanns continue to protest their innocence.
Madeleine was sleeping in the same room as her younger twin brother and sister at the resort of Praia da Luz when she disappeared on May 3 while her parents enjoyed a night with friends at a nearby tapas bar.
She would have celebrated her fourth birthday on May 12.

Just a few notices about Mcann's

§ 2256. Definitions for chapter
How Current is This?
For the purposes of this chapter, the term—
(1) “minor” means any person under the age of eighteen years;
(2)
(A) Except as provided in subparagraph (B), “sexually explicit conduct” means actual or simulated—
(i) sexual intercourse, including genital-genital, oral-genital, anal-genital, or oral-anal, whether between persons of the same or opposite sex, or lascivious simulated sexual intercourse where the genitals, breast, or pubic area of any person is exhibited;
(ii) graphic or lascivious simulated;
(I) bestiality;
(II) masturbation; or
(III) sadistic or masochistic abuse; or
(iii) graphic or simulated lascivious exhibition of the genitals or pubic area of any person;
(3) “producing” means producing, directing, manufacturing, issuing, publishing, or advertising;
(4) “organization” means a person other than an individual;
(5) “visual depiction” includes undeveloped film and videotape, and data stored on computer disk or by electronic means which is capable of conversion into a visual image;
(6) “computer” has the meaning given that term in section 1030 of this title;
(7) “custody or control” includes temporary supervision over or responsibility for a minor whether legally or illegally obtained;
(8) “child pornography” means any visual depiction, including any photograph, film, video, picture, or computer or computer-generated image or picture, whether made or produced by electronic, mechanical, or other means, of sexually explicit conduct, where—
(A) the production of such visual depiction involves the use of a minor engaging in sexually explicit conduct;
(B) such visual depiction is a digital image, computer image, or computer-generated image that is, or is indistinguishable from, that of a minor engaging in sexually explicit conduct; or
(C) such visual depiction has been created, adapted, or modified to appear that an identifiable minor is engaging in sexually explicit conduct.
(9) “identifiable minor”—
(A) means a person—
(i)
(I) who was a minor at the time the visual depiction was created, adapted, or modified; or
(II) whose image as a minor was used in creating, adapting, or modifying the visual depiction; and
(ii) who is recognizable as an actual person by the person’s face, likeness, or other distinguishing characteristic, such as a unique birthmark or other recognizable feature; and
(B) shall not be construed to require proof of the actual identity of the identifiable minor.
(10) “graphic”, when used with respect to a depiction of sexually explicit conduct, means that a viewer can observe any part of the genitals or pubic area of any depicted person or animal during any part of the time that the sexually explicit conduct is being depicted; and
(11) the term “indistinguishable” used with respect to a depiction, means virtually indistinguishable, in that the depiction is such that an ordinary person viewing the depiction would conclude that the depiction is of an actual minor engaged in sexually explicit conduct. This definition does not apply to depictions that are drawings, cartoons, sculptures, or paintings depicting minors or adults.

Maddie....the never ending story
After one day of reflection i used to read almost all i could find in net, there is only one thing i can say for sure:
The Mccan's are guilty of neglect the 3 kids.
The Mccann's are guilty of lying(several times) .
And i showed several here in other comments, the differences between what they said and what really happened.
The Mccann's had been trained to show an image,(they had the best in media to help them).
So,the cold and sometimes smily posture,i think was imposed by those experts who surrounded them(even the rose cat everywhere with Kate ,makes part of the game).

Well i can say one thing:
A person that talks like this knows the police wont find the body.
I still belive one thing...if they did it,they had help,and local help.
And i say more....if was so....this murder was not an accident....needed to be well thinked.

Last night, some of my sources in UK told me to be careful. Others were more clear and advised me to ask for Police protection, because I'm dealing with “something very powerful” that “isn’t exactly happy” with the news I published in the last 24 hours, at Gazeta Digital. And I'm sure that they didn't mean the British government or the McCann couple. And those sources, believe me, they know what they are talking about.When I heard that, I remembered a comment from a British journalist who phoned us (me and my colleague Duarte Levy) asking if we had more details about a specific story we had published. After giving him some details more, we asked him if he was planning to write about it. “I will only mention this to my Editor”, he told us. “But first I have to check my life insurance.”It's now 07h24 am, September 13, 2007. More than two hours ago, I published this tittle: “Desperate attempt to stop a rising tide - Justine McGuinees and Angus McBride met yesterday with editors of six British daily newspapers”. I will publish, within one and a half hour, at 9.00 am, details about what was discussed in some of those meetings and will show the results, quite visible in today's editions of several British newspapers.I appreciate the concern of those sources, some of them my friends, also. I don't have a life insurance. And I am not planning to ask for Police protection. What God gives, God takes. When my time arrives, it's because He decided it's my time. Though I walk through the valley of the shadow of death, I will fear no evil, because the Lord is my Shepherd.
My only life insurance are the readers of Gazeta Digital and the readers of SOS Madeleine. THERE IS SOMETHING I CAN'T UNDERSTAND ABOUT MADDIE'S AFFAIR
For persons who came to Portugal in holydays, and if it is true the Mccann's killed or accidentaly she died and they become scared,they had to have someone who knew well the place to carry the body and make it desapear.
It's not a five minutes decision.
And as the body was not found(even is easy to hide it),was not an amateur service.
Needed logistic,means(i don't belive in the theory of the transport in the hired car).
Maybe a contamination....with what i can't see).
The body had to be hiden long before the Mccann's gave the alarm.
Hide a body, near the coast is easy:
You have the silent sea....just a boat,a bag,some stones and....with luck never gonna be found.
So,we may say this counts in favour of Mccann's.

1-They left 3 children alone for 3 hours and said they reached them every half hour?(all of the group friends,except one who stayed a bit with his kid who was vomitting)....but went to dinner any way(the employees at the restaurant said the Mccanns never lived the table).
2-Why say to a female neighbour that they already phone the police when was not true?
3-Why call Sky News before call the police?(that i can understand cause we don't know who did it;if was Kate...very strange,if was one of the friends....well understandble.
4-Why say they could see the window when that was not true?(that i think is because they knew the mess they done)-in normal circunstances when back UK,Social Security could give them problems,even took the twins.
5-Why Kate said the window was forced from the outside when it was opened from the inside?

Maureen glanced out the window of her home. Her residential street had been transformed. Police lights cast an eerie blue and blood-red wash over the prim post-war facades of the houses. Television lights flared. Firefighters, cops and volunteers, 300 of them, some from as far away as Bucks County in neighboring Pennsylvania, gathered into platoons, waiting for the order to take their search for the little girl in ever-widening arcs through the backyards and weedlots of Hamilton. It was the dawn of the get-tough-on-crime era, and, with the blessing of the leaders of his Republican Party and support from both sides of the aisle, Zimmer and his colleagues hastily cobbled together a package of bills, which, among other things, required that anyone convicted of a sex offense undergo evaluation. The bills required that the risk sex offenders posed to the community be assessed and that, depending on that assessment, the community be notified.
For those deemed least likely to resume their criminal behavior, only the local authorities would be notified. Those considered a moderate risk would have their names circulated among police, local schools and community groups, and for those considered the most dangerous, a public alarm would be sounded once they were released back into the community.
On the surface, the law seemed to present a reasonable and reassuring answer to a real danger, and it was quickly embraced by the state's then-attorney general, Deborah Poritz (now chief justice of the New Jersey State Supreme Court), by then-governor Christine Todd Whitman (now the head of the federal Environmental Protection Agency) and by leaders in both houses of the state legislature.
And so, within weeks of its introduction, thanks in part to the moving testimony and unflagging support of Maureen Kanka, Megan’s Law was overwhelmingly adopted. Two years later, when Zimmer went on to Congress, he saw to it that a version of the New Jersey statutes became federal law.
But from the beginning there were those who warned that the law had serious flaws. For one thing, early studies, such as one conducted in Los Angeles County, indicated that information disseminated about convicted sex offenders was often wrong. Real, hard-core pedophiles often gave authorities bogus addresses or moved without warning, making the registration effectively useless, the Los Angeles study found.
Prosecutors, noting that the vast majority of sexual offenses, particularly those against children, were solved only when the offender confessed, warned that the laws could backfire. Threatening accused molesters with lifelong registration made it that much more difficult to force an admission of guilt, obligating prosecutors to risk losing cases and exposing victims to additional trauma at trial, they said.
What's more, many offenders had been convicted or pleaded guilty in the past to less serious offenses, crimes that did not rise to the level of Megan's Law notification. Notably, the name Jesse Timmendequas, Megan's killer, would not have been publicly released if the sex offenders’ registry had existed at the time of the girl's death. His prior offenses would not have warranted widespread community notification. A popular saying among prosecutors in New Jersey's 26 counties is, "Megan's Law would not have saved Megan."

CHILD PORNOGRAPHY--THE WAY IT IS
Child pornography is more or less a bye product of WW2, and the resulting technologies , and advancements in communications . As well as the mixing of cultures and ideas that come from increased travel. They say like minds have a way of seeking each other out, this is most certainly true of pedophiles , and those that seek CP. I can only guess as to the first publication of CP but I would not be surprised if it did not pre date 1900. Almost the same can be said of Kiddy Porn movies, most likely some were made in the early 1900's. Again , almost impossible for most to get their hands on. I would be almost right in saying that Child porn was as hard to find pre WW2 as gold, for most people.
Thankfully such material was scarce and hard to come bye. I wont go into 30year old + males marrying 8 year old girls a 100+ years ago , but in some countries this is still acceptable , where child porn would get your hand cut off. Hmmm a loop hole or what ?
Post WW2. With increased travel throughout the world , east meats west. With south east Asia having much more freedom in sexual behavior and a more tolerant attitude to sexual deviancy . It doesn't take long for the West to get a taste for such freedom . A similar attitude is taking place in certain parts of Europe , which in the 70's will be referred to as the sexual revolution of the 60's. A lot of experimenting in drugs , music , and cultural behavior was taking place. Some good , some very bad. This was the breeding ground for organized pedophile activity and the resulting CP industry, in both Europe and Asia. The main country in Asia exporting CP was J****, with many countries in Europe doing the same.
Production of CP would seem to have come a little late in the USA with many states banning such material early on. Unfortunately demand for such material has a way of finding people prepared to supply it. This has led to children being kidnapped , raped in the production of the material, and then murdered. This has become a serious problem , and is most likely understated by authorities. With most countries banning CP in Europe , a similar problem of murdered and kidnapped children being used to make CP is raising its ugly head in Europe.
To say that the internet was a God send for pedophiles is an understatement worthy of a medal. The timing could not have been better. With country after country banning CP and bringing in tougher laws regarding the interaction of adults and children , pedophiles were being driven underground. Then came the internet, here was a new way to recruit people , and spread the message, trade pictures and best of all , become a world wide phenomenon. No longer bound by language, or borders , or time or distance. This brought about a boom in pedophile and CP activity, a boom that went from the early 90's to almost 2000. This was a time for unprecedented growth , and the creation of an organized campaign for desensitizing the general public to the plight of children, and the increase in the spread of CP, and related propaganda .
With this growth came money, smarter people, and power. Pedophiles control more of the internet than most people could imagine. They have created a organization , with leaders , a hierarchy if you will. And operate like terrorist cells , if one cell is caught, there are two to take its place, and only the leaders of each cell know each other and are known to the cell manager, whom may manage up to 10 cells. All this is done on the net with very few members meeting , except at the higher levels where the big $ start to come in. Then things are run more like a corporation , than a criminal organization.
CP is big business , bringing in 100's of millions of dollars to those that control it. With this kind of money at stake , you can bet that these people are not going away without a fight. More and more people are taking part in supplying material for the Cp market, home videos , computers , home editing, and cable accesses to the internet, are just making things easier for the pedophiles and want to bees. The fight against them is poorly organized, and to me, I dont think that most law enforcement agencies through out the world realize just how big , and how bad things have become.
The simple truth is that there is a war waging against our children, a war that 99% of the populace of the world does not know about, and as it would seem, dont want to know about. Evil is knocking on the doors of our children, in every corner of the world, there is no longer anywhere to hide , the internet has given the monsters a way to reach your children even when the doors are locked. There is nowhere to hide. But you can fight , if you wish. To save the children.

In 2005, de Lichtbuer became chairman of the International Centre for Missing and Exploited Children (ICMEC), headquartered in Washington and founded in 1999.
Who is this Lichtbuer?
First of all, he is quite big in the financial world, with former positions in Banque Bruxelles Lambert, the Belgian Bankers' Association, VP Bank Liechtenstein (with Nikolaus von Liechtenstein), Thomas Cook Traveller Cheques and the European Financial Marketing Association. He also has been executive president of the aristocratic Europa Nostra.
But things become really problematic upon reading that de Lichtbuer is a member of the honorary committee of Cercle de Lorraine, together with with Maurice Lippens and Etienne Davignon. Equally worrying is his position as honorary executive president of the Koninklijke Vereniging der Historische Woonsteden en Tuinen van België, together with prince Alexander de Merode (former chair) and Count Ghislain d'Ursel. Davignon used to be a board member too. There's another indication that de Lichtbuer might not be the best choice for an anti- child abuse organization:
1998, Stef Janssens, 'The names from the cover up', p. 33: "In 1989, [Nicolas] de Kerchove d'Ousselghem [CEPIC; chef de cabinet of Vanden Boeynants; contact of VdB to the PIO intelligence organization] and Paul Vankerkhoven, CEPIC member and co-founder of Cercle des Nations [among many other things]... were employees of the magazine 'Revue Belge'. This right-wing magazine had as manager the present director of the Center for Missing Children and former BBL-director Daniel Cardon de Lichtbuer. What in itself is not reprehensible, but does say something about the milieu in which the present director of this Center was involved with." To clarify, that milieu appears to be the highest level child abuse milieu.
