FORT MYERS: Several of the men convicted after being caught last year during an internet sex sting conducted by Dateline NBC are already out of jail. Others have had certain charges dropped or reduced.

NBC2 investigator Kathryn Simmons started digging through court files and noticed a pattern. Many of the men that were prosecuted got sentences as short as nine months.

The "To Catch a Predator" series on Dateline is based on using decoys to act like underage girls on the internet to talk to possible sexual predators. A meeting is set up and when the suspect arrives – he or she is arrested.

It may make for good TV, but it’s not making for a good court case.

Police say as soon as the suspect shows up they have committed a felony, but some legal experts disagree.

Defense attorney Robert Harris represented one of the two dozen men caught in the Fort Myers sting.

"The plea bargain was made. I believe in most of these cases because the prosecution and defense were unsure of what level of legal ground we are on," said Harris of the Wilbur Smith Law Firm.

The question facing the legal system is – how do you know the men were about to commit a sexual crime?

That is why most of the suspects have been offered the same deal: Admit to computer pornography and the attempted lewd and lascivious battery charges disappear.

Law enforcement says outdated laws are resulting in light sentences.


"The current laws that we are working under, they are very weak because state statutes have not caught up with the computer era," said Fort Myers Police Chief Hilton Daniels.

But possible changes are on the way. On Wednesday, Florida Attorney General Bill McCollum proposed a bill that could keep an online predator in prison for 15 years if they show up in person to meet a child.

Simmons discovered that of the eight convictions from the Fort Myers Dateline sting, four men have already been released. Sixteen other men that were arrested are still waiting for their day in court.

"I believe the longest sentence that we have is nine months, that's not nearly enough to convince these people not to go on the internet and look for their next victim," said Chief Daniels.

But despite that, Daniels says he would still invite Dateline back to Fort Myers for another sting.

Authorities say the computer pornography convictions do have serious consequences. It’s a third degree felony that comes with three years probation and it requires the person to register as a sexual offender with the state.

The arrest came days after the Brazilian magazine Epocha reported that Stanley, a fugitive who has lived in Brazil since 1998, had built an international business photographing Brazilian girls and selling their photos through the Internet.Epocha "pressured the police into arresting [Stanley] and carting off all his negatives, hard drives, CDs and books, without a shred of evidence of wrongdoing other than the lies in the magazine article," a spokesman for Stanley's Internet company wrote in a statement July 4.At a hearing July 8, a Brazilian federal judge ordered that Stanley remain in custody until trial after receiving the report of an investigation from Rita Sanchez, head of the Center for Human Rights. Stanley faces up to four years in prison if convicted.Under the alias L.A. Stanaman, Stanley operated the "MiniModels" Web site, featuring photos of girls ages 8 to 14 in what police Officer Rui Gomes described to the Associated Press as "sensual poses." Police said Stanley paid the girls $20 to $40 for each photo session. 1 - Rui has been kidnaped in 04/03/1998 in Lousada,Portugal,wasa 11 at the time.

2-A strange person,Afonso Dias,at the time with 21 and not working,was companion of children half is age,sharing their plays.

3-The same Afonso had a dutch rallycross friend he met in the Lousada autocross and since he met him(before Rui kidnaping)become friends and Afonso strated to go to Dutch country often.

4-Rui Pedro cousin told that in kidnaping day Afonso invited them to go see the whores in a place nearby.

5-Both mothers didn't aloow so the cousin stayed home but,Rui Pedro was with Afonso the rest of the evening in a Fiat Punto black.

6-In post office Afonso deny having been with Rui,but a neighbour saw them and after Rui's grandfather beg he told something very strange - Close all frontiers or u loose the boy.

7-A young woman told the police that she saw Rui in a whore house in Oporto.

Police found out that was a house where the starting whores stayed before be puted in "work".

8-The place owner said it was her nephew and the police drop that line.

9-D. Filomena,Rui Pedro's mother says that Afonso bought a new car some days after Rui kidnaping,even not working or having a source of money.

10-Six months after Rui kidnaping,a pic took by accase and puted in magazine Caras,show behind a society person Rui with a man in Disneyland-Paris.

11-That man was identified as a security of a dancing bar in Oporto.

16-In the village of Rui Pedro, a man is known to turn of films of pornography and the father of this man would have precisely returned from France to Portugal at the time of the disappearance of Rui Pedro, dislocated of his station abroad because suspected of paedophilia. These two men would have been heard by the Portuguese police force, but would not be worried, "for lack of reasonable evidence".

17-Rui Pedro was tracked by an Missing ppl association,but someone in Portugal blocked the track.
